  1. Overview

1.1 Introduction

These TikTok Shop Gambling, Gifting and Surprise-based Products Guidelines have been formulated with the express purpose of:
  • Building a positive shopping environment on TikTok Shop; and
  • Providing users with a confident shopping experience.
All sellers and creators who offer products for sale on TikTok Shop must abide by these guidelines and our Merchant Terms of Service.

1.2 Scope

These TikTok Shop Gambling, Gifting and Surprise-based Products Guidelines cover all content and product listings on TikTok Shop. They are not exhaustive or intended to act as legal advice. Sellers/creators are responsible for ensuring that the listing, sale and provision of products on TikTok Shop comply at all times with applicable laws and regulations. Sellers/creators must seek independent legal advice if they have questions about any applicable laws and regulations concerning their listings and products.Our TikTok Shop policies and guidelines are updated periodically. Sellers/creators are responsible for checking this page regularly to ensure that they comply with our current policies and guidelines.
  1. Gambling (Prohibited)

The carrying out and/or promotion of all gambling activities is strictly prohibited on Livestreams and Videos on TikTok Shop. Gambling-related products, services and paraphernalia are also not allowed to be sold on TikTok Shop. These include, but are not limited to:
  • Roulette and Roulette Game Entry
  • Lottery Tickets
  • Lucky Scoop
  • Mystery Egg
  • Claw Machine and Claw Machine Entry
  • Oyster Opening Entry
  1. Gamification (Prohibited)

Gamification typically occurs when a game uses an element of chance (including randomisation techniques) to determine the recipient(s) of the prize(s) or the prize(s) a user will receive. This can be in instances where the buyer pays or does not pay to participate. Gamification behaviour typically occurs when the seller utilises elements of gameplay or chance as a buyer engagement technique. Gamification is strictly prohibited on TikTok Shop . Gamification services, behaviours and related activities are not allowed to be conducted by sellers/creators on TikTok Shop. Additionally, the use of gamification and games of chance on Livestreams/Short Videos is also prohibited. These include but are not limited to:
  • Lucky Spin
  • Lucky Wheel
  • Giveaway Entry
  • Lucky Scoop
  • Lucky Draw
  1. Surprise-Based Products (Restricted)

TikTok Shop considers products to be surprise-based if an element of mystery or surprise is an integral part of the product the user is purchasing (i.e. the customer is not certain of the contents of the product until they receive it). Surprise-based products must never offer a consequential upside or downside in the form of 'lost' or 'gained' items of monetary value. Examples include, but are not limited to, mystery boxes, advent calendars or golden eggs.To promote customer safety and better-informed purchases, surprise-based products are restricted on TikTok Shop. Sellers who wish to list Surprise-Based products must comply with the following requirements:

Surprise-based boxes/ packages/ bundlesThe product(s) contains single/multiple items that are securely sealed in a box/package/bundle at a factory. The possible product, product quantity, category and variation that could be included in the box are known to buyers; however, the final products that the buyer will receive in the box/package/ bundle are unknown until the product is opened. Examples include, but are not limited to Mystery Box, Golden Eggs, Advent Calendars, and Surprise Trading Card Packs. Note:
  • Randomised bundles self-assembled by brands/ sellers/creators are strictly prohibited.
  • In addition, all cross-border sellers must be invited by TikTok Shop to be allowed to sell this type of product.
  1. The product must be manufactured in a factory and cannot be assembled by brands, sellers or creators. They must be purchased and resold in the manufacturer's original packaging and content without any alterations. All sold product(s) must also be sealed.
  2. The seller must include all the following information clearly in their listing description:
    1. Visual image(s) showing the possible product(s) the buyer may receive in the surprise-based product listing;
    2. The quantity, category, and variation of products the buyer may receive when purchasing the surprise-based product listing.
    3. The value of the product(s) that the buyer will receive.
  3. The product as a whole must be less than USD100.
  1. Free Giveaways

To conduct free giveaways, Sellers and creators must only use the LIVE Giveaway feature on TikTok Shop. The LIVE Giveaway feature is a platform function that facilitates product giveaways between you and customers. Please click here to learn more. In addition, you must also adhere to the following guidelines:
  • Giveaways must be completely free and not require a purchase.
  • No gambling, gamification (as outlined in 2 and 3), or randomization methods allowed.
  • Cash, virtual currency, and gift cards are prohibited.
  • Clearly state giveaway details, including:
    • Entry method (i.e. Tasks viewers must complete before they may click "Claim".)
    • Duration, number of winners, and prize details
    • Winner selection process and claiming method
  • You are solely responsible for the giveaway and must not imply any affiliation with TikTok Shop.
  1. Purchase-Based Incentives

Purchase-based incentives include instances when the user is eligible for free gift(s) as a result of purchasing a product, but there is no gamification or elements of gambling involved (such as wheel spin, lucky draw or lucky scoop).TikTok Shop allows purchase-based incentives in the following scenarios:
  • Buy one, get one free (i.e. users can purchase an item and receive the same additional item)
  • Buy one, get one or several item(s) free (i.e. Users can purchase an item and receive different items)
  • The use of official TikTok Shop promotional tools (e.g. Gift with Purchase)
If sellers/creators are not using TikTok Shop promotional tools (e.g. Gift with Purchase), purchase-based incentives are only allowed if they meet all of the following criteria:The free gift(s) or incentive(s) must be listed in either product title, product image or product description.The free gift(s) or incentive(s) must be consistent with what was promoted.All buyers must receive the same free product(s). The free product(s) must be of the same price and category type. The free item cannot be cash, virtual currency or gift cards.The following terms of the purchase-based incentive must be explicitly stated on the relevant content/product listing:
  1. The mechanism of the free giveaway (e.g. buy one, get one free)
  2. The free gift or incentive
  3. The duration of the free product(s) being made available (e.g. During the duration of the Livestream only)
    Sellers/creators must make it clear to users that sellers/creators are solely responsible for the incentive and must not associate or affiliate the incentive with TikTok Shop in any way (e.g. sellers/creators must not expressly state or do anything to suggest that TikTok Shop is involved, associated with or has endorsed the incentive).
    1. Enforcement Actions and Appeal

    TikTok Shop periodically reviews the content and product listings of all sellers and creators on our platform. Sellers/Creators who are deemed to have violated these guidelines or local regulations will have enforcement actions taken against them in accordance with our TikTok Shop Seller Performance Evaluation Policy, Creator Performance Evaluation Policy and Merchant Terms of Service. Sellers should note that repeated offences will result in increased enforcement actions.A non-exhaustive list of the actions we may take are as follows:
    • Removing the product from the platform
    • Removing or blocking content
    • Formal warning messages
    • Suspension of creator/seller privileges
    • Temporary or permanent withdrawal of creator/seller benefits
    • Reporting the creator/seller to the relevant regulatory authorities for prosecution
    If a seller/creator believes that an enforcement action was taken against them in error, they may file an appeal through the Seller Center or the TikTok App by raising a ticket. TikTok Shop will then investigate the case and take corrective actions where applicable. Sellers/creators should note that they are responsible for collecting and preparing all supporting documents that may be required during a case investigation.
